Assigning a surname to a child pursuant to Article 90 §1 of the Family and Guardianship Code requires a record to be drawn up by the Head of the Registry Office when the interested parties make a declaration on assigning a surname. This activity is carried out immediately when the interested persons report to the Office. If the mother of a minor child is married to a man who is not the child's father, the spouses may make a joint declaration before an elected head of a register office or a consul that the child will have the same surname as their joint child has or would have. To change the surname of a child who has reached the age of thirteen, his/her consent is required. The conferment of the said surname on a child shall not be permissible if the child bears his father's surname or a surname formed by the joint declarations of the child's parents by an amalgamation of his mother's and his father's surnames. The above provisions shall apply mutatis mutandis where the father of a minor child has entered into a marriage with a woman who is not the child's mother.
